1. Purpose

These Terms of Service (hereinafter “ToS”) govern access to and use of the YachtSecure platform accessible at www.yachtsecure.com (hereinafter “the Platform”), published by FROLSON.

YachtSecure offers a free yacht insurance policy analysis service, featuring the proprietary YachtSecure Insight™ solution, combining artificial intelligence and human expertise to provide detailed insurance contract analysis.

Use of the Platform implies full acceptance of these ToS.

3. Definitions

• User: Any natural or legal person using the Platform
• Account: Personal space created by the User to access services
• YachtSecure Insight™: Proprietary insurance policy analysis solution combining AI and human expertise
• Analysis: Process of extraction, validation and evaluation of insurance policy data
• RAG (Retrieval-Augmented Generation): Proprietary knowledge base system for insurance general conditions
• Analysis Report: Document resulting from analysis, including validation, comparison and in-depth study

4. Platform Access

4.1 Access Conditions

Access to YachtSecure services requires:

• Creating a user account (mandatory)
• Being a natural person of legal age (18 years minimum)
• Accepting these ToS
• Providing accurate and up-to-date information

4.2 Account Creation

To create an account, the User must:

• Provide a valid email address
• Choose a secure password
• Complete the requested information
• Accept the Privacy Policy

The User is solely responsible for maintaining the confidentiality of login credentials. Any use of the account is deemed to have been performed by the account holder.

4.3 Service Availability

FROLSON strives to ensure Platform availability 24/7. However, FROLSON reserves the right to temporarily interrupt access for:

• Technical maintenance
• Updates
• Force majeure events
• Security reasons

5. Service Description

5.1 YachtSecure Insight™ Service

YachtSecure offers a free service for comprehensive yacht insurance policy analysis.

How it works: The complete analysis process, technologies used, and technical details are described on our Policy Analyzer page.

Summary:

• Upload your insurance policy (PDF, max 15 MB)
• Automatic extraction and analysis by our proprietary YachtSecure Insight™ system
• Interactive validation via dynamic questionnaire
• Generation of detailed report with market standards comparison
• Optional comparative quote request

5.2 Proprietary Technology

YachtSecure Insight™ combines:

• Advanced artificial intelligence (LLM and OCR)
• Proprietary RAG knowledge base of general insurance conditions
• Expertise from senior brokers with decades of experience
• 100% secure infrastructure on proprietary servers

5.3 Analysis Report Content

The report includes:

• Validation of extracted data against your responses
• Detailed comparison with market standards
• In-depth study of critical points (if General Conditions are in our database)
• Recommendations for coverage improvement

6. Usage Limitations

6.1 Per-User Quota

Free limit: 1 (one) vessel analyzable per user account.

To analyze multiple vessels: Users must contact FROLSON directly via contact@yachtsecure.com or the Platform’s contact form.

6.2 Strictly Personal Use

Prohibited:

• Commercial or professional use of the Platform
• Resale or redistribution of analyses
• Use by brokers/professionals on behalf of their clients
• Creating multiple accounts to circumvent the one-vessel limit

Authorized only: Personal use by the yacht owner for their own needs.

6.3 File Format and Size

Only accepted:

• Format: PDF only
• Maximum size: 15 MB
• Readable documents (not corrupted, not password-protected)

7. User Obligations

7.1 Compliant Use

The User agrees to:

• Use the Platform fairly and in accordance with its intended purpose
• Provide accurate information when creating the account and during interactive validation
• Not upload fraudulent, illegal or counterfeit documents
• Respect the one-vessel per account limit
• Not attempt to circumvent technical or security limitations
• Not use the Platform for commercial purposes

7.2 Prohibited Behaviors

Strictly prohibited:

• Any attempt to intrude or hack the Platform
• Use of robots, scripts or automated tools to access the service
• Collection or extraction of data from the Platform
• Reverse engineering of the YachtSecure Insight™ system
• Distribution of viruses, malware or malicious code
• Identity theft or creation of fake accounts

8. Intellectual Property

8.1 FROLSON Property

The following are the exclusive property of FROLSON:

• The YachtSecure Platform and its source code
• The YachtSecure Insight™ system (algorithms, AI models, business logic)
• The proprietary RAG database of general conditions
• The design, interface, graphics, logo
• The generated analysis reports (structure, format, methodology)
• All technical documentation

Any unauthorized reproduction, representation, modification or exploitation constitutes infringement sanctioned by Intellectual Property law.

8.2 Uploaded Documents Ownership

The User retains all rights to the documents they upload (insurance policies). By uploading a document, the User:

• Guarantees having all necessary rights to such document
• Grants FROLSON a limited, non-exclusive and revocable license to process the document solely for providing the analysis service
• May delete their documents at any time from their account

8.3 Usage License

FROLSON grants the User a personal, non-exclusive, non-transferable and revocable license to:

• Access the Platform
• Use the analysis service for personal purposes
• View and download their analysis report

This license confers no ownership rights to the Platform or YachtSecure Insight™ technology.

9. Personal Data and Security

9.1 Data Protection

Processing of personal data is governed by our Privacy Policy in compliance with GDPR.

9.2 Maximum Security

Secure architecture:

• Proprietary servers: Your data is processed exclusively on our secure servers
• Zero third-party APIs: No confidential data is transmitted to external services
• Closed-loop system: Your insurance policies never leave our secure environment
• GDPR compliance: Full compliance with European regulations
• US standards: CCPA compliance and US data protection principles
• European AI Act: Compliance with European AI regulations

9.3 Data Retention

PDF files:

• Not physically retained after analysis
• Only extracted data is stored

Extracted data:

• Retained while account is active
• Deletable at any time by the User
• Automatically deleted 3 years after account closure

10. Liability Limitations

10.1 Nature of Service

Information and decision support tool:

The YachtSecure Insight™ service provides technical and comparative analysis of your insurance policy for informational purposes only. Reports and recommendations do not constitute:

• Personalized legal or financial advice
• Guarantee of optimal coverage
• Contractual or legal validation
• FROLSON’s commitment regarding your policy’s validity

It is strongly recommended to consult an insurance professional or specialized attorney before making any important coverage decisions.

10.2 Analysis Accuracy

While our system combines advanced AI and human expertise to achieve near-optimal accuracy:

• FROLSON does not guarantee absolute (100%) analysis accuracy
• Results depend on quality and readability of uploaded documents
• Some non-standard clauses may not be detected
• User responses during interactive validation influence results
• Complex legal nuances may require additional human expertise

10.3 Liability Exclusions

FROLSON cannot be held liable for:

Direct or indirect damages:

• Decisions made based on provided analyses
• Errors or omissions in analysis reports
• Unidentified coverage gaps
• Financial losses resulting from service use
• Claims not covered by your policy

Technical issues:

• Service interruptions
• Temporary bugs or malfunctions
• Data loss due to force majeure
• Incompatibility with certain browsers or devices

Misuse:

• User’s use contrary to these ToS
• Erroneous information provided by User
• Fraudulent or falsified uploaded documents

10.4 User Responsibility

The User is solely responsible for:

• Verifying analysis accuracy with their insurer
• Validity and veracity of uploaded documents
• Responses provided during interactive validation
• Decisions made regarding insurance coverage
• Compliance of their use with these ToS

11. Free Service

11.1 Free of Charge

The YachtSecure Insight™ analysis service is completely free. No payment is required to:

• Create an account
• Upload an insurance policy
• Receive a complete analysis report
• View results

11.2 No Purchase Obligation

Using the service does not entail:

• Any obligation to purchase an insurance policy
• Any obligation to modify your current coverage
• Any commercial commitment with FROLSON

11.3 Quote Request (Optional)

If you choose to request a comparative quote:

• This action is entirely voluntary
• You will be contacted by a FROLSON broker
• No obligation to accept presented proposals
• Proposed rates depend on partner insurers

12. Suspension and Termination

12.1 Suspension by FROLSON

FROLSON reserves the right to suspend or delete any account immediately and without notice in case of:

• Violation of these ToS
• Prohibited behaviors (§7.2)
• Unauthorized commercial use
• Creating multiple accounts to circumvent limitations
• Hacking or intrusion attempts
• Uploading fraudulent documents
• Suspicious or fraudulent activity

12.2 Termination by User

The User may at any time:

• Close their account from Platform settings
• Request permanent account deletion via privacy@frolson.com

12.3 Effects of Termination

Upon account closure:

• Platform access is immediately revoked
• Data is retained for 3 years then deleted (legal obligations)
• User may request immediate data deletion (subject to legal obligations)
• Previously downloaded analysis reports remain User’s property

13. ToS Modifications

13.1 Terms Evolution

FROLSON reserves the right to modify these ToS at any time to:

• Improve services
• Comply with legislative changes
• Adapt features

13.2 Notification

Substantial modifications will be notified via:

• Email to registered account address
• Platform notification
• Update of “Last updated” date at top of page

13.3 Acceptance

Continued use of the Platform after ToS modification constitutes acceptance of new terms.

If the User refuses new ToS, they must cease using the Platform and may request account deletion.

Response time: We strive to respond within 48 business hours.

14.2 24/7 Expert Support

Our team of senior brokers is available 24/7 to:

15. Applicable Law and Jurisdiction

15.1 Governing Law

These ToS are governed by French law.

15.2 Mediation

In case of dispute, Users are invited to contact FROLSON first to attempt amicable resolution:

Failing amicable resolution, Users may resort to consumer mediation:

15.3 Competent Jurisdiction

In absence of amicable agreement, the competent courts of Antibes shall have exclusive jurisdiction, notwithstanding plurality of defendants or third-party proceedings.

16. Miscellaneous Provisions

16.1 Entire Agreement

These ToS, together with the Privacy Policy and Legal Notice, constitute the entire agreement between the User and FROLSON regarding Platform use.

16.2 Severability

If any provision of these ToS is declared null or unenforceable, other provisions remain fully effective.

16.3 Non-Waiver

FROLSON’s failure to exercise a right provided by these ToS does not constitute waiver of such right.

16.4 Language

These ToS are written in English. In case of translation, only the English version shall prevail.
